Terms of Service

The terms that govern your use of the SOCIGATE website and the services offered through it.

Last updated: October 10, 2026

1. Introduction

Welcome to SOCIGATE. These Terms of Service govern your access to and use of the SOCIGATE website and the services offered through it.

SOCIGATE provides marketing, branding, creative, consulting, and technology services to businesses and other clients.

In these Terms, “SOCIGATE,” “we,” “us,” or “our” refers to the SOCIGATE brand and, where applicable, the legal entity identified in the relevant proposal, order, invoice, or signed agreement.

By accessing our website, you agree to these Terms to the extent applicable to your use of the website. A separate written agreement may apply to services purchased from us. If a signed agreement conflicts with these Terms regarding a specific project, the signed agreement will govern that project to the extent of the conflict.

2. Our Services

SOCIGATE offers services that may include:

  • Digital marketing and marketing strategy
  • Search engine optimization (SEO)
  • Paid advertising and campaign management
  • Social media management
  • Brand strategy and visual identity
  • Creative design, content creation, and production
  • Photography and visual production

  • Growth marketing and business consulting

The availability, scope, and specifications of individual services may change over time. The services applicable to a particular client will be described in the relevant proposal, order, or agreement.

3. Project Proposals and Agreements

Before work begins, SOCIGATE may provide a proposal, quotation, statement of work, or other written agreement describing the applicable services.

Depending on the project, this document may specify:

  • Project scope and deliverables
  • Fees and payment schedule
  • Estimated timelines and milestones
  • Client responsibilities and required materials
  • Revision limits and approval procedures
  • Ownership and licensing of deliverables
  • Cancellation, termination, and refund conditions

A project is considered accepted when the applicable proposal or agreement has been accepted in the manner specified in that document.

Any changes to the agreed scope may affect fees, deliverables, and timelines. Additional work may require a written change order or a separate agreement.

4. Client Responsibilities

Clients agree to provide accurate information, necessary materials, timely feedback, and reasonable cooperation required for the performance of the agreed services.

Clients are responsible for ensuring that materials they supply, including text, images, trademarks, videos, and other content, may lawfully be used for the intended purpose.

Delays caused by missing materials, delayed approvals, inaccurate information, or circumstances outside SOCIGATE's reasonable control may affect project timelines.

5. Fees and Payments

Fees, payment methods, due dates, deposits, recurring charges, and any applicable taxes will be specified in the relevant proposal, invoice, checkout page, or agreement.

Payments may be processed through third-party payment service providers. Their terms and privacy practices may also apply to the payment transaction.

Unless expressly stated otherwise in the applicable agreement, payment for one project does not include unrelated services, additional revisions, third-party subscriptions, advertising spend, domain registrations, hosting, or other external costs.

Clients remain responsible for charges expressly agreed to in their project agreement, including approved third-party costs.

6. Revisions, Approvals, and Deliverables

The number of revisions, approval process, delivery format, and delivery schedule will be determined by the applicable project agreement.

Clients should review submitted work and provide feedback within the agreed review period. Delayed feedback or approval may affect delivery dates.

Work outside the agreed scope may require additional fees and an adjusted timeline.

7. Intellectual Property

Each party retains ownership of intellectual property it owned before a project began.

Unless otherwise agreed in writing, SOCIGATE retains ownership of its pre-existing materials, tools, methods, templates, frameworks, and reusable components.

Ownership or licensing of final project deliverables will be determined by the applicable written agreement. Any transfer of ownership may be subject to full payment of the relevant fees and any other conditions stated in that agreement.

Third-party materials, fonts, software, stock assets, plugins, and other licensed resources remain subject to their respective license terms.

Clients may not reproduce, distribute, modify, or commercially exploit SOCIGATE's website content or other protected materials without the necessary permission, except where permitted by applicable law.

8. Third-Party Platforms and Services

Our services may involve third-party platforms, including advertising networks, social media platforms, analytics tools, hosting providers, software providers, and payment processors.

These third parties operate under their own terms, policies, availability, and technical requirements. SOCIGATE does not control their independent decisions, service interruptions, policy changes, or platform algorithms.

Where a project depends on a third-party platform, the client may be required to maintain its own account, permissions, subscriptions, or payment arrangements.

9. Results and No Guarantee

SOCIGATE works toward the objectives agreed with each client. However, marketing performance, search rankings, advertising results, conversion rates, revenue, audience growth, and software outcomes may depend on factors outside our control.

Unless expressly agreed in a written contract, SOCIGATE does not guarantee specific rankings, revenue, leads, conversions, advertising returns, audience growth, or business outcomes.

Examples and case studies presented on our website are illustrative of particular projects and should not be interpreted as a guarantee of equivalent results.

10. Acceptable Use

You agree not to:

  • Use the website for unlawful, fraudulent, or deceptive purposes.
  • Attempt to gain unauthorized access to the website or its systems.
  • Interfere with website functionality or security.
  • Submit malicious code, spam, or harmful content.
  • Infringe the intellectual property, privacy, or other rights of others.
  • Misrepresent your identity or authority when contacting SOCIGATE.

We may restrict access to the website where reasonably necessary to protect its security, users, or lawful operation.

11. Confidentiality

Where a project involves confidential information, the parties should identify and protect that information in accordance with their applicable written agreement and applicable law.

Nothing in these Terms authorizes either party to disclose confidential information where disclosure is prohibited by an applicable confidentiality obligation.

12. Cancellation and Refunds

Project cancellation, termination, and refund eligibility are governed by the applicable project agreement and our Refund & Cancellation Policy.

Clients should review that policy before making a payment or entering into a project agreement.

Nothing in these Terms excludes any non-waivable rights or remedies available under applicable law.

13. Website Content and Availability

We aim to keep our website accurate and available, but we do not guarantee uninterrupted access or that all website content will always be complete, current, or error-free.

We may update, modify, suspend, or remove website content or features when reasonably necessary.

14. Limitation of Liability

To the extent permitted by applicable law, SOCIGATE will not be liable for indirect, incidental, special, consequential, or punitive losses arising from the use of the website or services, including loss of profits, revenue, business opportunities, or data.

Any limitation of liability relating to a paid project will be governed by the applicable project agreement and applicable law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

15. Indemnification

To the extent permitted by applicable law, you are responsible for losses, claims, or expenses arising from your unlawful use of the website, your infringement of third-party rights, or your material breach of these Terms.

This section does not apply to the extent that the relevant loss results from conduct for which you cannot lawfully be held responsible.

16. Privacy

Our collection and use of personal information are described in our Privacy Policy and, where applicable, our Cookie Policy.

By using the website, you acknowledge that you have been given access to those policies. This acknowledgment does not replace consent where consent is legally required.

17. Changes to These Terms

We may update these Terms from time to time. The revised version will be published on this page with an updated revision date.

Changes apply from the stated effective date, subject to applicable law and any separate written agreement governing an existing project.

18. Governing Law and Disputes

The governing law and dispute-resolution arrangements for a paid project will be specified in the applicable written agreement.

For website use not covered by a separate agreement, applicable law will determine the parties' rights and obligations. Nothing in this section deprives a consumer of mandatory protections that cannot lawfully be waived.
